Injury Law in the News

Oct. 29th, 2005 - The U.S. House of Representatives passed H.R. 420, entitled the Lawsuit Abuse Reduction Act. The bill, which is being forwarded to the Senate, is designed to allow judges to sanction and punish lawyers that file frivolous lawsuits, but the American Trial Lawyers Association claims that this is a redundancy, as Judges in all 50 states already have the ability to do so.

Also included in the language of the bill is a requirement that any lawsuits must be either filed where the injury took place or in the jurisdiction of the defendant’s business. This means that if a plaintiff is injured by the product of actions of a foreign country, the plaintiff would have to travel outside of the United States in order to file a lawsuit.

Slip and Fall Injuries? Contact us Today.

Have you suffered an injury as a result of slipping and falling in a grocery store, a mall or other public building? Has your child been injured on school property, a playground, at a recreation center or on other public premises? If so, then you may have rights to compensation for all of the expenses of the injury, including pain and suffering, medical bills and lost time at work. In Virginia, property owners and/or custodians of public buildings and stores are required to carry insurance policies to protect them from liability in the event that someone is injured on their property.

But just because an insurance policy is in place, this doesn’t make it easy for an injured person to obtain fast and fair settlements for the injury. Insurance companies routinely dispute slip and fall injuries and other types of premises injuries. The attorneys of Breit, Drescher & Imprevento challenge these stalling tactics and bring the strength of justice to our clients’ cases. We move cases forward quickly and effectively, with minimal involvement required from our clients. When you are a client of Breit, Drescher & Imprevento, your only job is to heal from your injuries. Our job is to ensure that the process of healing doesn’t cost you your financial future.

Personal Injury Cases in Virginia: The Basics

Personal injury law is also known as tort law. A tort is described as "a civil wrong or wrongful act, whether intentional or accidental, from which injury occurs to another.” Torts include all negligence cases as well as intentional wrongs which result in harm. Torts fall under three categories:

  • Intentional torts - purposely inflicting injury.
  • Negligent torts - causing an accident which results in injury.
  • Strict liability torts - manufacturing, marketing or selling defective products that result in injury.

The most common grounds for a civil lawsuit involve negligence. These include motor vehicle accidents, pedestrian accidents, dangerous products, medical malpractice, and premises liability (slip and fall) accidents. When an accident occurs due to negligence, the injured party may file a claim against the negligent party to recover all their damages. Damages generally include current and future medical expenses, property damage, pain and suffering, current and future loss of income, loss of enjoyment and in certain cases, punitive damages.

In order to prove negligence, your personal injury attorney must support your claim with the following three facts:

  • Negligence - The other party was negligent.
  • Causation - Their negligence caused the accident.
  • Damages - You suffered damages as a result of the accident.
