Injured Motorcyclist Receives $150K Verdict PDF Print E-mail

While leading a group of motorcyclists on Interstate 264, our client, the plaintiff, was suddenly forced to brake when a John Doe vehicle merged onto the highway and stopped in front of the group.

The plaintiff experienced locking brakes and as a result the motorcycle spun out of control and hit a guardrail. He sustained an avulsion fracture of the right medial talus and road abrasions with scarring to both arms. This accident was investigated by a Virginia state trooper, however, there were no witnesses to these events and the anonymous driver fled the scene. The prosecution instructed the jury on contributory negligence and the defense maintained that the accident could have been avoided if plaintiff lost control exercised proper judgment. A verdict in the amount of $150,000 was the end result.
